KickThemBot is operated by Šimon Robin Mach, a sole trader registered in Czechia under business registration number (IČO) 06316760.

Not registered for VAT. Prices carry no VAT.
These terms are an agreement between you and Šimon Robin Mach. Questions about them go to support@kickthembot.com.
What the service does
KickThemBot lets a Telegram admin sell access to a group or channel, track memberships, send renewal reminders, and remove members whose access has ended.
@KickThemBot and your project's service bot need admin rights on the Telegram groups and channels you connect. They use them to create invite links, check people who join against membership records, and remove members whose access has ended.
The bots act on messages people send to them directly, such as an access code, an email address or a USDT transaction hash, and on Telegram's updates about members joining. KickThemBot does not store or moderate the conversations in your groups and channels.
Text you write for KickThemBot itself, such as plan descriptions, reminders, payment instructions and member messages, is stored so it can be shown or sent.
Telegram also sends channel posts to @KickThemBot. It uses them only to copy posts between specific channels set in KickThemBot's own server configuration, and it does not store them.
Your responsibilities
You are responsible for what you sell access to, for your own tax obligations, and for complying with Telegram's terms.
You are responsible for the accuracy of the plans, prices, and access rules you configure.
You must be at least 18 years old to use KickThemBot as an owner.
Keep your Telegram account, bot tokens and agent tokens secure. Anyone holding a bot token controls that bot.
Acceptable use
Do not use KickThemBot to sell access to, or distribute, illegal content, or to run any activity you are not legally allowed to run.
Do not use member messages for spam. Send them only to members of your own community, about that community.
Follow Telegram's terms and Stripe's terms whenever you use them through KickThemBot.
We may suspend a project or account that breaks these rules. Where it is reasonable, we tell you first and give you a chance to fix the problem.
Billing and cancellation
Paid plans are billed in advance, monthly or yearly, through Stripe. Yearly plans are charged as a single payment.
You can cancel at any time. Cancelling stops the next charge; access continues until the end of the period you already paid for.
Cancelling is done in the bot and takes the same number of steps as subscribing.
Refunds
Refunds are available within 14 days of a charge.
Plan limits
Each plan has limits, including active members, projects, access codes per month, membership plans and member messages per day. The current limits are on the pricing page. When you reach a limit, KickThemBot refuses the next addition above it until you upgrade or reduce usage.
If we lower plan limits and your account ends up above them, we tell you in @KickThemBot and give you 10 days. During those 10 days you cannot add members or create access codes.
If your account is still above the limits after 10 days, your service bots, checkout and website activations stop admitting new members until you upgrade or reduce usage.
Existing members are not removed because of this. Renewals, invite links for active members, expiry and the normal removal of expired members carry on.
USDT payments
If you turn on USDT payments, buyers send USDT straight to the wallet address you save. KickThemBot never receives, holds or forwards crypto and is not a party to that payment.
KickThemBot does not verify payments on the blockchain. It records the buyer's claim, the amount they were asked to send and any transaction hash they give. You or a helper confirm or reject each claim by hand after checking your wallet.
You are responsible for that check, for the wallet addresses and networks you save, and for refunds and disputes about USDT payments. Helpers cannot change wallet addresses. Claims nobody confirms expire after 7 days.
AI agents
You can let an AI agent set up and run your account through the owner API. An agent gets only the permissions you approve in @KickThemBot, and it acts on your behalf.
You are responsible for what your agent does with those permissions, as if you had done it yourself.
Keep agent tokens secret, and revoke any agent you no longer use or trust with /agents. A revoked token stops working, and project API keys it created stop working too.
Connecting Stripe is never delegated to an agent. Only you can do it, in @KickThemBot.
An agent can propose USDT wallet addresses and a buyer note, but nothing changes until you confirm the proposal in @KickThemBot.
Personal data and processing
The Privacy Policy at /legal/privacy/ explains how we handle personal data.
For your members' personal data, you are the controller and we are your processor. By using KickThemBot you instruct us to process that data to run the service as you configure it. We process it only on those instructions, unless the law requires otherwise.
We keep that data confidential and protect it with the measures described in the Privacy Policy. We use the sub-processors listed there.
We tell you at least 14 days before adding or replacing a sub-processor. If you object, you can close your account with /delete_account.
We help you answer your members' data protection requests. We tell you without undue delay if we become aware of a personal data breach affecting your members' data. We give you the information you reasonably need to show these obligations are met.
When you close your account, your members' data is deleted 90 days later, or sooner if you ask. Records the law requires us to keep are the exception. You can export your member list first.
Closing your account
You can close your account at any time with /delete_account in @KickThemBot. You confirm the closure in the bot, and the service stops for your account.
Closing your account cancels your KickThemBot plan subscription at the end of the current billing period.
Your members' subscriptions run on your own Stripe account and are yours. KickThemBot does not cancel them: cancel them in your Stripe account.
Your account, projects and member data are deleted 90 days after you confirm, unless you cancel the closure in the bot before then. Payment and accounting records are kept for 10 years, as Czech law requires.
Availability
We do not offer a contractual uptime guarantee. The service depends on Telegram and Stripe, both of which can be unavailable for reasons outside our control.
We may pause the service briefly for maintenance or to deal with a security problem.
Liability
Our total liability to you for all claims is limited to the fees you paid KickThemBot in the 12 months before the claim arose. If you paid nothing in those 12 months, the limit is EUR 100.
We are not liable for loss caused by Telegram, Stripe or a blockchain network being unavailable or changing their services. We are also not liable for a USDT payment you confirmed without checking, or for actions of a helper or AI agent you authorised.
If you use KickThemBot for your business, we are not liable for indirect loss or lost profit.
The limit and exclusions above do not apply to harm caused intentionally or through gross negligence, or where the law does not allow liability to be limited, such as injury to life or health or your mandatory rights as a consumer.
Changes to these terms
If these terms change materially, existing customers are told before the change takes effect.
The current version is always on this page with the date it was updated. If you do not accept a change, you can cancel your plan and stop using the service before it takes effect.
Governing law and disputes
These terms are governed by Czech law, and disputes are decided by the courts of the Czech Republic.
If you are a consumer, you keep the protection of the mandatory laws of the country where you live, and you can also bring a claim in the courts there.
